Abstract

The workshop “Introduction to Mediation” has the potential to raise the awareness of lawyers, businessmen, professionals and the general public about mediation and its benefits by offering them knowledge that is necessary to navigate and resolve conflicts effectively. Mediation, negotiation and effective conflict management have become integral to resolving disputes peacefully in various legal, business, and human resources domains. By attending this course, individuals can gain more understanding of the nature of the mediation procedure according to ADR Center’s 5×5 methodology, its application and how its use may contribute to the overall well-being and productivity of organizations and society at large in the UAE.

Objectives

Provide an overview of the mediation procedure, its core principles and basic tenets that render it as one of the most effective tools for solving conflicts amicably. Participants shall further receive knowledge and will be equipped with the necessary tools to facilitate effective processes, following ADR Center’s 5×5 mediation methodology for describing the mediation process.

Workshop Overview

The workshop provides participants with a comprehensive understanding of what mediation is, how the process is structured applying ADR Center’s 5×5 mediation methodology and what applications it may find. Furthermore, the course will offer participants an overview of the principles that guide the procedure and how it differs from other dispute resolution techniques. The course will offer additionally a detailed overview of the 5×5 mediation matrix, which is designed in a way that enables both professional mediators, lawyers, facilitators, judges, policy makers, businessmen and the general public to improve their knowledge on mediation and prepare them to have a truly valuable experience at the mediation table. For this, the 1-hour course will include additional elaboration on the 5 steps for the 5 stages of mediation and will offer an overview of the practical activities, strategies, skills and tools this involves. Through an introduction to mediation and practical exercises, participants will delve into conflict theories and negotiation skills to better comprehend disputes’ dynamics and develop strategies for successful mediation.

Course Content

  • Introduction to mediation;
  • Principles governing mediation;
  • 5×5 mediation matrix;
  • The effective management of the mediation process following the 5×5 mediation matrix (1. Preparation / bilateral meetings, 2. Fact-finding/opening joint session, 3. Exploration / initial private sessions, 4. Negotiation / later private sessions, 5. Resolution/closing phase);
  • Developing mediation skills and Effective communication;
  • Videos, exercises, and other possible activities.
The ADR Center approach to training mediators and mediation trainers is based on the ADR Center’s 5×5 matrix that describes the mediation process and has successfully transferred the know-how from practitioners to new mediators and mediation advocates.

The faculty of ADR Center Academy includes highly experienced mediators and trainers mostly from ADR Center’s international panel with years of experience in the field of ADR and a proven track record of successfully mediating complex cross-border disputes as well as designing and delivering training courses all over the world. Our trainers are, in fact, highly skilled professionals of different nationalities with a multicultural professional background and the ability to work alongside people with different cultures. All our trainers fluently speak English in addition to one or more languages in order to design and conduct an international training program. The trainers of ADR Center Academy have a combined experience of training more than 15.000 mediators around the world.
